Terms and Conditions

These Terms and Conditions ("Terms") govern the use of the services provided by NEF Media, a subsidiary of Alister Creative Agency ("Company"). By accessing or using the services, the user ("User") agrees to be bound by these Terms. If the User does not agree with these Terms, the User should not use the services.

1. Company Details:

• Name: NEF Media, a subsidiary of Alister Creative Agency

2. General Use:

• There are no specific rules or guidelines for the general use of the website or services.

3. Products and Services:

• Services Offered: NEF Media offers video editing services purchased in prepackaged amounts. Users send footage to NEF Media, and the footage is edited based on provided instructions or created solely based on the footage. No edits, changes, or modifications are permitted unless there is a spelling mistake in captions caused by NEF Media. If copy is provided by the User, it will be added as is without verification.

4. Purchases and Payments:

• Billing: Purchases are auto-billed monthly at the rate stated on the website plus applicable taxes. Users are responsible for sending content monthly. A credit card is required for purchases and will be billed every 30 days. Payment must be provided in full upfront.

5. User Responsibilities:

• Content Submission: Users are responsible for sending footage to be edited, which can be raw or edited footage. Users must provide instructions; otherwise, NEF Media will create content based on its discretion of what the footage can provide in a social media setting.

6. Intellectual Property:

• Ownership: Users own all footage sent to NEF Media. Once the edited videos are delivered, Users retain complete rights to the work. NEF Media holds no ownership over the work once payment is made.

7. Limitation of Liability:

• Generic Clause: NEF Media shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) the User's use or inability to use the service; (ii) any unauthorized access to or use of the servers and/or any personal information stored therein; and (iii) any bugs, viruses, trojan horses, or the like that may be transmitted to or through the services by any third party.

8. Termination:

• Conditions: NEF Media reserves the right to terminate or suspend access to the services upon failure to pay or if payment has been suspended for more than 60 days.

9. Governing Law:

• Jurisdiction: These Terms shall be governed and construed in accordance with the laws of Quebec, Canada, without regard to its conflict of law provisions.

10. Changes to Terms:

• Notification: NEF Media may update these Terms from time to time. Users will be notified of any changes by posting the new Terms on this page. Users are advised to review these Terms periodically for any changes.
